R v Samedi (CO 45 of 2013) [2015] SCSC 117 (13 April 2015);
IN THE SUPREME COURT OF SEYCHELLES
Criminal Side: CO 45/2013
[2015] SCSC 117
THE REPUBLIC
versus
CLIFTON SAMEDI
Accused
Heard: 13 April 2015
Counsel: Mr Ananth, for the Republic
Mr. Andre for the accused
[1] The Convict is 31 years old. The father of 2 girls of 5 years and 3 months. He has pleaded guilty and saved the Court’s time and expenses of holding a trial. As stated by Counsel he has always been present when the case has been called although he lives on Praslin and for the purposes of this case he is a first time offender.
[2] Although for possession, the law does not require a mandatory prison sentence, I have noted that particularly in the last few cases that such cases continue to be on the rise and are very serious to society so a prison sentence in any event will be called for in such circumstances.
[3] I will impose a sentence of one year imprisonment on the Convict. If he has served any time on remand during that time that would be deducted from the sentence.
[4] The Convict may appeal against the sentence within 30 working days.
Signed, dated and delivered at Ile du Port on 13 April 2013.
